In view of changed legal position, the learned Senior Advocate seeks leave to press first prayer in the writ petition. He points out that in the light of Full Bench judgment of this Court in the case of Arun Vishwanath Sonone vs. State of Maharashtra, reported at 2015 (1) Mh. L.J. 457, holding the field and other judgments, on 28.08.2014 that prayer was given up.

The respective respondents fairly give their no objection. They submit that appropriate reply to this prayer will be filed on merits.

In this situation, we allow and dispose of the said civil application and restore the deleted prayer clause (i) in Writ Petition No. 1927 of 2014 back to file. The necessary amendment be carried out within a period of one week. 5.

Liberty to the respondents to file their reply/ additional reply, within a further period of three weeks. JUDGE JUDGE *GS.
