The applicants are challenging the order dated 18/11/2019 regarding rejection of discharge application by the Judicial Magistrate First Class. The remedy of revision in terms of Section 397 of the Code of Criminal Procedure is available. The applicants' learned Counsel seeks permission to withdraw the application with liberty to approach to the Court of Sessions.

02] In view of the above, the application stands disposed of since withdrawn with liberty as prayed for. 03] The learned Sessions judge shall entertain the revision on its own merits without considering the point of limitation provided that the revision is filed within three weeks from today.
