(i) The criminal application is disposed of as withdrawn. (ii) The applicant is granted liberty to file an application for .....2/-

(iii) Learned Judge of the Court below should decide the said application in accordance with law.

(iv) It is made clear that the case of the applicant is not heard on its own merits.
