Heard learned counsel for the petitioner.

At the outset, the learned counsel for the petitioner submits that the encroachment is not removed by the respondents authorities though they are duty bound to remove it. He has invited our attention to the communication dated 24.03.2023 issued by the Office of the Collector, Bhandara to the Chief Officer, Municipal Council, Bhandara. 3.

Be that as it may, since the issue can be resolved in the light of the communication dated 24.03.2023, we direct the respondent-Chief Officer, Municipal Council, Bhandara, to act on the communication dated 24.03.2023 within a period of ten weeks from the date of production of copy of this order before him.

Learned counsel for the petitioner undertakes to produce the copy of the order passed today before the respondent-Chief Officer, Municipal Council, Bhandara within two weeks.
