Shri M. Ateeque, learned Counsel for the applicants, Shri R. Nayak, learned A.P.P. for respondent no.1 and Shri S.A. Malani, learned Counsel for respondent no.2.

After hearing the learned counsel for the applicants as well as the learned counsel for respondent no.2/original complainant, the matter can be disposed of by following order :

(1)Before the learned Trial Court, the petitioner no.1 Muhammed Sajid Muhammed Yunus Khaku, shall be appearing. Whereas the

Order 1711apl673.15 petitioner Nos. 2- Muahammed Yunus Muhammed Yusuf Khaku, 3-Tayara w/o Mohd.

Yunus Khaku, 4-Sunera w/o Afzal Gandhi, 5Afzal Gandhi, 6-Shajiya Bano Firoz Memon and 7- Shabina Irfan Nikki, may not appear before the learned Magistrate. They are allowed to appear through their Counsel. The application filed by them for exemption should be considered favourably by the learned Magistrate.

(2)All the applicants shall be at liberty to move such other applications, as are advisable in law.

(3)All the points raised in the present Criminal Application are kept open.
