The learned Counsel for the petitioner, on instructions, seeks permission to with the petition in order to avail remedy of appeal as provided under Section 160 of the Maharashtra Police Act with a request that if the appeal is filed, the same may be disposed of within the stipulated period.

Permission, as sought for, is granted. The criminal writ petition is disposed as withdrawn, as prayed for.

We hereby direct the Divisional Commissioner to decide the appeal, as and when it is filed, within ten days from the date of it's presentation.
