02] The petitioner seeks stepping up of her pay-scale so that it would be at par with the pay-scale of that teacher, who is junior to her. Representation in that regard has been made to the Director, Institute of Science, Nagpur-respondent No.3 on 11/05/2023. The petitioner seeks consideration of the aforesaid representation.

03] The learned Counsel for the petitioner submits that this Court in Writ Petition No.994/2023 (Dr Tapan Netaichandra Dutta vs. The State of Maharashtra and others) has on 13/02/2023 issued directions to Director of Higher Education, Pune - respondent No.2 to decide such representation and take a decision on the same on merits. 04] In view of aforesaid, the writ petition is disposed of by directing the Director, Institute of Science, Nagpur-

46.wp.5578.23 2/2 respondent No.3 to forward to respondent no. 2 the petitioner's representation dated 11/05/2023 in the matter of stepping up of her pay-scale. The respondent no. 2 to decide the representation of the petitioner on its own merits and in accordance with law preferably within a period of six months from date of receipt of the representation. In case the pay of the petitioner is stepped up, consequential effect shall also be given to the pensionary benefits.

05] Rule accordingly. No order as to costs.
