The applicant is arrested on 21.04.2017 in connection with Crime No.100/2017 registered with Police Station, Kanhan, Nagpur for an offence punishable under Sections 324, 506, 326 and 302 of the Indian Penal Code.

The investigation is over and charge-sheet is already filed. Statement of the witnesses are also recorded. From the statements and from the FIR it appears that the unfortunate incident has occurred on account of trifle issue. Looking to the nature of accusations made in the FIR and other evidence, in my view, further custodial presence of the present applicant is not necessary. Hence, following order is passed.

ORDER

(i) Criminal Application No.794/2017 is allowed.

(ii) Applicant-Pruthviraj Devchand Chauhan is directed to be released on bail in connection with Crime No.100/2017 registered with Police Station, Kanhan,

ba794.17.odt Nagpur for an offence punishable under Sections 324, 506, 326 and 302 of the Indian Penal Code, on he executing PR Bond in the sum of Rs.25,000/- with one solvent surety in the like amount. The applicant shall attend Police Station, Kanhan once in a month i.e. on last Sunday of every month between 3.00 p.m. to 5.00 p.m. till the culmination of trial.

The applicant shall not enter the territorial jurisdiction of Kanhan city. As stated by the learned counsel for the applicant, he shall reside at village Yesamba and shall furnish his residential address at Yesamba to the Court below at the time of execution of bail bonds and also to the investigating officer. The applicant is permitted to enter the jurisdiction of Kanhan city only on the last Sunday of every month to report to the Police Station.

The applicant shall not tamper with the prosecution evidence and shall not try to influence the prosecution witnesses.
