The respondent No.4 has filed this application praying that the interim order granted on 21st July, 2016 be vacated.

This Court issued notice to the respondents on 20th May, 2016 and recorded that if the charge of the post of Sarpanch is not taken from the petitioner, the parties shall maintain status quo as on 20th May, 2016. The matter was listed on 21st July, 2016 and after hearing the learned advocate for the petitioner and the learned A.G.P. Rule is issued and by an interim order it is directed that the effect, operation and execution of the impugned orders shall stand stayed till disposal of the writ petition.

The submission made on behalf of the respondent No.4 is that the charge of the post of Sarpanch was taken from the petitioner on 19th May, 2016. There is no explanation why the respondent No.4 has not appeared on 21st July, 2016 and has not opposed the grant of interim order.
