The order impugned is appealable. By and under the order impugned the application seeking dismissal of petition instituted under Section 12 of Protection of Women from Domestic Violence Act, 2005 is rejected. 2.

The learned Counsel for the petitioner seeks leave to withdraw the petition with liberty to take recourse to the appellate remedy under Section 29 of Protection of Women from Domestic Violence Act, 2005.
