In the present writ petition the challenge is raised to the impugned judgment and order dated 20.02.2017 passed by the Member, Industrial Court, Bhandara, dismissing the Complaint (ULP) No.1 of 2015 filed by the petitioner on denial of appointment to him on the post of Civil Engineer, Assistant.

The learned Industrial Court dismissed the complaint on the ground that for appointment on post of Civil Engineer, Assistant a condition to complete one year course of Civil Engineering Services from Government Technical Institute was there. The Court has held that though the said course was completed from Indian C.L.Dhakate

23.wp.7554.18.odt Technical Education Society, Mumbai, but not from the Government Technical Institution.

The learned counsel for the petitioner has informed that the petitioner has got superannuated on 13.04.2017.

In the circumstances, as nothing is pointed out fulfilling the requirement of qualification for appointment on the post of Civil Engineer Assistant, I am of the opinion that no error has been committed by the learned Industrial Court in rejecting the complaint.

Accordingly, the writ petition is dismissed.
