After arguing the matter for some time, the learned counsel for the applicant seeks permission to withdraw the present application as this Court has expressed disinclination to grant bail. However, it is submitted that the applicant is in jail since last more than thee years and as the applicant is suffering from serious ailment, this Court may grant liberty to move a fresh application, if there will be no progress in the trial, in near future.

Permission to withdraw the application is granted with liberty to move a fresh application for grant of bail, in case there will be no significant progress in the trial in next one year.

The Criminal Application is disposed of accordingly.
