Heard Shri N.R. Mankar, learned counsel (appointed) for the petitioner and Mrs. N.R. Tripathi, learned APP for the respondents.

First leave in the shape of furlough is declined on the ground that during trial the petitioner has threatened the witnesses. The petitioner is in prison for last more than 41⁄2 years.

In this situation, the apprehension is based upon alleged threats extended by him. The petitioner is denying any such threats.

We direct the petitioner to furnish one more surety in addition to his wife. The petitioner as also his sureties shall apart from other conditions file undertaking not to contact directly or indirectly any of the witnesses in trial and the petitioner shall also report at local Police Station once in every two days.
5.
After obtaining necessary bonds and undertaking from the petitioner and his sureties, he shall be released on furlough leave within next three weeks.

Criminal Writ petition is accordingly partly allowed and disposed of.

The charges of counsel appointed for the petitioner are fixed at Rs.1,500/-.
