The respondent Shri Ajit Sagne, Secretary, Department of Public Works, Mantralaya, Mumbai is personally present in the Court.

The affidavit filed on behalf of the respondent is taken on record. The affidavit candidly admits the fact that there has been delay in this matter. The affidavit also gives some relevant facts, which contributed to occurrence of the delay in the matter. The affidavit also tenders unconditional apology for the delayed decision taken in this case, in compliance with the order of this Court.

2011cp245.19.odt Upon consideration of the relevant dates mentioned in the affidavit and also one relevant document, which is about the steps taken by the respondent to avoid such delay in future in Court matters and also warning given to the concerned officers, we are satisfied that the delay in taking decision in the matter was not deliberate and therefore, no case is made out for proceeding further in the matter. In fact, during the pendency of the petition, the contempt has also stood purged.

In view of above, the contempt petition is dismissed. No order as to costs.
