--------------------------------------------------------------------------------------------------------------------------------- Shri B.G. Kulkarni, Advocate for Appellant.

Shri B.H. Tekam, Advocate for Respondent.

CORAM: S.B. SHUKRE & S.M. MODAK, JJ.

DATE: 25 th JANUARY, 2019.

Although, this Court would as much like as the party to hear and dispose of this appeal as expeditiously as possible, owing to some practical difficulty, it appears that the priority with the same intensity as is the expectation of the party cannot be possibly granted to this appeal. There are several Family Court Appeals which are pending for final hearing in this Court. This appeal belongs to a category which requires priority hearing but this would be only in the category of all other pending Family Court Appeals and that would mean that the longest pending Family Court Appeal would have to be given its priority more than the other Family Court Appeals which have been recently filed. Therefore, we direct that this appeal be listed for final hearing as per its seniority amongst all the Family Court Appeals as and when its turn comes through. We also

cao1386.18.O.odt make it clear that all Family Court Appeals as a category would be given priority hearing by this Court, as far as it is possible and practicable.

Put up after six months.
