The interim application filed by wife was allowed on the basis of affidavit of assets and liabilities of the parties and the Trial Court has granted interim maintenance of Rs.13,000/- to the respondent - wife. 3.

The learned counsel appearing for petitioner submits that without hearing the petitioner, the order of interim maintenance was passed. He further invited my attention to the Roznama wherein it is stated that nonapplicant was absent. 4.

I have gone through the order passed by the Trial Court wherein interim maintenance of Rs.13,000/- Prity

2 / 2 11.wp640.2025 was granted, however, it is specifically stated in that order both the parties were heard. It further appears from the record that the order is passed on the basis of the affidavit of assets and liabilities filed by both the parties, wherein the income of the husband was shown as Rs.1,13,356/-. 5.

Considering the above facts and circumstances, I do not find any perversity or error in the order dated 13.06.2024 wherein the interim maintenance of Rs.13,000/- was granted.

In this view of the matter, the petition is devoid of merits and hence, is dismissed.
