The applicant/respondent No. 1 has filed this application to permit him to withdraw the compensation amount deposited by the appellant, for which learned counsel for the appellant has objected. 3.

Having considered the reasons stated in the application as well as having gone through the impugned judgment and order, I do not find substance in the objection of learned counsel for appellant. Hence, the application is partly allowed.

The applicant is permitted to withdraw 50% compensation amount along with interest accrued thereon on his furnishing a usual undertaking to the satisfaction of the Registry. 5.

Registrar (J) is directed to transmit the 50% compensation amount along with interest accrued thereon in the bank account of the applicant, within eight weeks, on his furnishing the usual undertaking and bank account details to the Registry. (ABHAY J. MANTRI, J.) Belkhede
