Present appeal is preferred by the appellants against the judgment and decree dated 20.08.2005 passed by the 7th Ad-hoc Additional District Judge, Nagpur in Regular Civil Appeal No.226 of 2004 arising out of order passed by the 2nd Joint Civil Judge, Junior Division, Nagpur in R.D. No.85 of 1995 below Exh-53 arising out of the judgment and decree dated 20.03.1986 in Regular Civil Suit No.1406 of 1984.

During pendency of the appeal, both the parties i.e. appellants and respondent arrived at the amicable settlement and they have filed the application with prayer that compromise decree be drawn up, in terms of Compromise Agreement dated 18.04.2023. The Compromise Agreement is also filed on record, which is accepted by both parties. I have personally interacted with both the parties and they have accepted and agreed the terms and conditions of the Compromise Agreement and have no grievance about the same.

In view of the above, the appeal is to be disposed of, as TAMBE

5 SA-40-2006 settlement arrived between the parties. The compromise decree be drawn up accordingly, in view of the terms and conditions of the Compromise Agreement.
