Applicant is apprehending his arrest in connection with Crime No.75/2019 registered with Police Station, Risod, Dist. Washim for an offence punishable under Sections 143, 147, 148, 307, 363, 504 and 506 of the Indian Penal Code.
Criminal law was set into motion by Vijay Dhondiram Babar who has suffered injuries in the incident. The first information report is dated 12.03.2019. As per first information report, co-accused - Bharat Shinde was nourishing grudge against him since previously this Bharat Shinde was assaulted by the residents of Nijampur and Bharat was nursing grudge that Vijay Babar, was one of the members of the group. As per the report, on 10.3.2019 in
the night, he and his friend Akash were proceeding towards their house after attending Amardas Baba Yatra on motorcycle, at about 10:30 p.m. they were intercepted by three motorcycles and the accused persons were riding on those three motorcycles. The applicant was one of the riders. As per the report lodged by Vijay, he was assaulted by Bharat by means of iron rod. The allegation so far as the present applicant is concerned is that, other co-accused asked Vijay to sit on the motorcycle plied by the present applicant. There are general allegations against the present applicant by giving fist and kick blows.
Looking to the nature of the accusations, this Court on 22.08.2019 granted ad-interim protection to the applicant with a direction that the applicant shall attend the police station on 27.08.2019 and 28.08.2019 and shall remain with the investigating officer from 11:00 a.m. to 05:00 p.m. Learned counsel for the applicant submits that accordingly the applicant has attended the police station. Even this statement is confirmed by learned Additional Public Prosecutor on the basis of instruction received from the investigating officer.
Looking to the nature of accusation made against applicant and that he has already joined the investigation, in my view, application can be considered favourably. Consequently, I pass following order.
ORDER
(i) The application is allowed.
(ii) In the event of arrest in connection with Crime
No.75/2019 registered with Police Station, Risod, Dist. Washim for an offence punishable under Sections 143, 147, 148, 307, 363, 504 and 506 of the Indian Penal Code applicant- Aniket Prakash Jadhav be released on bail on he executing P.R. Bond in the sum of Rs.10,000/- with one solvent surety in the like amount.
(iii) Applicant is directed to attend Police Station, Risod Dist. Washim twice a month i.e. on second and third Sunday of every month and shall remain with the investigating officer between 03:00 p.m. to 05:00 p.m till filing of charge-sheet.
The application is disposed of.
