By this writ petition, the petitioner challenges the order dated 03.09.2014 based on the provisions of the Right To Education Act.
Shri Dhatrak, the learned counsel for the respondent no.1, states that the issue involved in this case was also involved in Writ Petition No.9026 of 2014 and the Division Bench at the Principal Seat has, by the judgment dated 15.12.2015, rejected the challenge to the provisions of the Right To Education Act. It is stated that in view of the said judgment, the relief sought by the petitioner cannot be granted. Shri Warulkar, the learned counsel for the petitioner, does not dispute the statement made by the learned counsel for the respondent-Municipal Council. In view of the aforesaid, for the reasons recorded in the judgment dated 15.12.2015 in Writ Petition No.9026 of 2014, we dispose of the writ petition with no order as to costs. JUDGE JUDGE APTE
