Adv. Sudame for petitioner only presses for relief in terms of prayer clause (iii) of petition. Shri Patil, learned Additional Public Proecutor points out that opinion of Handwriting Expert on documents is necessary and papers have been sent to Handwriting Expert recently.

In view of this position, we find that matter needs to be decided within reasonable time. Regular Criminal Case is of 1999. Hence, we direct Court of Judicial Magistrate, First Class (Court No.6), Nagpur to expedite the proceedings and to attempt to decide the same finally within one year

2/3 from the date of communication of this order. The petitioner as also said Court shall forward copy of this order to concerned Handwriting Expert to expedite the process of examination of documents by him/her.

The criminal writ petition is accordingly partly allowed and disposed of. No costs.
