It is a common ground that the parties in Lok-Adalat agreed that an amount of Rs.1.00 lakh shall be returned to the Insurance Company, however, while passing the award, the Panel has directed that an amount of Rs.1.00 lakh be returned to the appellant along with the interest accrued thereon, which was not incorporated in the order of the Tribunal. As per the agreement between the parties, only an amount of Rs.1.00 lakh was to be returned to the appellant without any interest. 03.

In view of this, the award needs to be modified. Hence, the appellant-insurance company is entitled to withdraw Rs.1.00 lakh only and the amount of interest accrued thereon shall be given to the claimants. The other conditions of the award shall remain intact. 04.

The application is disposed of accordingly.
