By the present application, the applicant is seeking interim bail for a period of two weeks on the ground of death of his father Shri Mulji P. Shah. The applicant has been arrested in connection with Crime No.I-375/2022 registered with Police Station, City Kotwali, Amravati for the offences punishable under Section 120B, 406, 409, 420, 465, 467, 468, 471 read with Section 34 of the Indian Penal Code and under Section 3 and 4 of the Maharashtra Protection of Interest of Depositors Act, 1999 thereafter transferred to Economic Offences Wing.

Since, it is a temporary bail application on the ground of death of his father, I need not to delve on the merits of case. Suffice, it to say that the father of applicant died today in morning at Mumbai. The medical certification of cause of death of father of the applicant, which is produced on record and marked as 'X' for the identification purpose, which
substantiate the fact submitted by the learned counsel for the applicant.

Learned APP does not dispute and fairly conceded that the applicant should be allowed to attend the funeral under police custody.

Learned counsel for the applicant submits that after funeral some more rituals are required to be performed and for that two weeks time is required. Therefore, he prays for releasing the applicant on interim bail for a period of two weeks.

It is informed by the learend counsel for the applicant that the passport of the applicant is lying with the Economic Offences Wing, Mumbai. Considering the fact that father of the applicant died today in the morning coupled with the fact that certain post funeral rituals are required to be performed by the applicant, in my view, the following arrangement would suffice the purpose.
ORDER
i.
The applicant - Paresh Mulji Kariya shall be released on interim bail till 01.09.2023 in connection with Crime No.I-375/2022 registered with Police Station, City Kotwali, Amravati thereafter transferred to Economic Offences Wing, for the offences punishable under Section 120B, 406, 409, 420, 465, 467, 468, 471 read with Section 34 of the Indian
Penal Code and under Section 3 and 4 of the Maharashtra Protection of Interest of Depositors Act, 1999, on executing PR bond in the sum of Rs.One lakh with one or two solvent sureties in the like amount or on depositing Rs.One lakh as a cash security.
ii.
The applicant shall attend the nearest police station i.e. Juhu Police Station on every day between 6 pm to 8 pm. iii.
The applicant shall surrender on 01.09.2023 before the Jail Authority, from where he is released on interim bail. iv.
The bail bond shall be executed before the trial Court. v.
An authenticated copy of this order shall be supplied to the parties.
