DATED :- SEPTEMBER 26, 2024 Heard learned Counsel for the applicant. Perused the earlier order passed by this Court by which only the trial Court was directed to expedite the trial. 2.

Learned Counsel for the applicant submitted that yet charges are not framed. The applicant is behind bar since 04/05/2022.

Learned Counsel for the applicant seeks permission to withdraw the application with liberty to file afresh after six months if there is no progress in the trial. 4.

Considering the huge pendency before the trial Court and considering the fact that the applicant is behind bar from last two years and there are repeated directions of this Court as well as the Hon'ble Apex Court that the precedence is to be given to the cases wherein the accused are under trial.

The Sessions Court shall proceed with the trial at earliest.

The liberty is to be granted to the present applicant to file afresh before this Court, if there is no substantial progress in the trial after nine months. 7.

The application is disposed of as withdrawn with liberty to file after nine months if there is no substantial progress in the trial.
