DATED : 12th DECEMBER, 2024 The appellant Priyanka W/o. Manoj Joshi is present in person and she seeks permission to withdraw the present appeal (FCA) No. 22/2018 in view of the settlement terms recorded by the learned Family Court No. 3, Nagpur dated 03/10/2023.

In para 4(ii) of the said terms, appellant has specifically stated as under:- "(ii) That, the respondent has paid amount of Rs. 5,00,000/- on 29/08/2023 to the daughter Kum. Riddhi and the remaining amount of Rs. 4,50,000/- paid on 03/10/2023 in the form of D.D. to the petitioner. That, after receiving the amount of Rs. 9,50,000/- petitioner is ready to withdraw all the above mentioned litigations pending before this Hon'ble Court. The
2 30) FCA 22-2018.odt petitioner has also challenged the judgment dated 17/05/2017, passed by this Hon'ble Court, before Hon'ble High Court in FCA bearing no. 22/2018. The petitioner is ready to withdraw the said litigation pending before Hon'ble High Court and will not claim any maintenance from the respondent for past, present and future."

As per these terms, she accepted that, she has received the amount of Rs. 9,50,000/- i.e. amount of Rs. 5,00,000/- towards maintenance of her daughter and amount of Rs. 4,50,000/- towards her maintenance.

Accordingly, the appellant seeks permission to withdraw the present F.C.A. pending before this Court.

Both the parties agreed that, all the allegations made in earlier litigations and the litigation pending before this Court are withdrawn. 6.
The respondent also voluntarily undertakes to open one Recurring Deposit (RD) A/c. in the name of his daughter Riddhi Manoj Joshi in the Post Office till her age of majority. Thereafter, the said amount will be invested in NSC or in any Nationalized Bank in the form of Fixed Deposit (FD) A/c. in the name of his daughter Riddhi Manoj Joshi.

As such, permission is granted to the appellant to withdraw the present appeal.

Accordingly, the Family Court Appeal No. 22/2018 stands dismissed as withdrawn.

Pending application(s), if any, is/are hereby disposed of.
