DATE : 26.10.2018 Heard Shri Jawade, learned APP for the applicant/State and Shri R.M.Tahaliyani, learned counsel for the non applicants. This Court while granting bail application imposed specific direction, which is reproduced as under : "Accordingly, the application of applicant Nos. 2 and 3, Shubhangi Kashyap and Ram Raut, is allowed and the interim anticipatory bail granted to them by this Court on 26th October, 2016, is hereby confirmed on the same conditions with the addition of the condition that now these applicants shall attend Office of the Economic Offences Wing, Crime Branch, Chandrapur on every Sunday between 10.00 a.m. and 12.00 noon till filing of the charge-sheet."

As per the submission of Shri Jawade, learned APP, there is no dispute that the non applicants/accused have deposited an amount of Rs.Two lakhs and they have also given specific signature, and handwriting, etc. Their presence is required till filing of the charge-sheet.

APPLN46.17 2/2 Learned counsel for the non applicants submitted that the non applicant no.1-Shubhangi is residing at Pune and therefore, it is difficult for her to attend Economic Offences Wing (EOW), Chandrapur, on every Sunday.

Looking to the submission of the learned counsel for the non applicants, it will be appropriate to direct the non applicants to remain present once in 15 days. Hence, the following order.

ORDER

(1) The application is partly allowed. Prayer for cancellation of bail is rejected.

(2) The non applicants/accused are directed to remain present in the Office of Economic Offences Wing (EOW), Crime Branch, Chandrapur, once in 15 days on Saturday.

The Application is disposed of accordingly.
