Effort is to point out inconsistency in statements under Section 161 of the Code of Criminal Procedure recorded earlier and after issuance of direction under Section 156(3) of the Code of Criminal Procedure.

The learned counsel also submits that as chargesheet is filed only under Section 294 of the Indian Penal Code and trial is summary in nature, there is no possibility of moving the application for discharge. 3.

Keeping all contentions open, if inconsistencies exist and can be looked into before the trial begins, we grant the applicant leave to move appropriate application raising all these contentions.

With this liberty, we dispose of the criminal application.
