DATED : 23/03/2023 This application is for condonation of delay of 302 days in filing the restoration application. As per contention of the learned Advocate Mr. Limaye for the appellant that inadvertently the office objections are not removed by the appellant as not noted earlier, therefore appeal is dismissed at the registration stage. The dismissal order is also not noted inadvertently, therefore delay of 302 days is caused in preferring the application.

Learned Advocate Mr. Chopde for the respondent Nos.1 to 4 has raised objection on the ground that delay is not properly explained.

(2) 28.cao.797.2022 In view of the reasons mentioned in the application and considering that public money is involved and the appellant is the Oriental Insurance Company and to do the substantial justice by giving opportunity to litigate the cause on merits, delay of 302 days is condoned.

MISC. CIVIL APPLICATION STAMP NO.15896 OF 2022 In view of the reasons mentioned in the application, the appeal be restored at registration stage subject to removal of the office objections, within two weeks.
