Heard.
Shri Rahul submits that though caste claim has been decided, considering the fact that it ought to have been adjudicated upon within six months and there is a delay of more than 12 months, a case for contempt is made out. He points out that the petitioner is about 75 years of age.
Advocate Dangre submits that caste claim has already been decided and the order of invalidation has again been questioned by the petitioner before this Court by filing writ petition and that writ petition is admitted for hearing.
0104cp245.13 As the caste claim has already been decided, considering the fact that the Committees are still not having proper infrastructure and on several occasions Members are not available, we are not inclined to interfere in contempt jurisdiction. This Court has already taken note of the situation and has also issued appropriate directions for improvement. Though there is some substance in the contention of learned counsel for the petitioner, we dispose of the contempt proceedings. No costs. Judge Judge /TA/
