ATED : 19th December, 2019 By means of this Application, the applicant has challenged the judgment and order dated 20th August, 2019 delivered by learned Additional Sessions Judge, Nagpur in Criminal Appeal No. 56/2017 arising out of the judgment and order dated 8.2.2017 in Summary Criminal Case No.1902/2016 thereby confirming the conviction of the applicant u/s 138 of the negotiable Instruments Act.

Learned counsel appearing for respective parties submit that the matter has been amicably settled between the parties before the learned Mediator on 10.12.2019.

Perused the mediation report, which is marked as Exh."A"; whereas the agreement dated 9th December, 2019 is marked as Exh."B' . The agreement shows that before the learned mediator both the parties have signed the consent terms i.e. agreement. It is submitted that the terms in the said agreement have been complied with, in as much as the entire amount of Rs. 55,000/- has been paid by the applicant to the respondent, towards compensation.

19.12.REVN.197.19 In view thereof, the impugned order dated 20.8.2019 delivered by learned Additional Sessions Judge in Criminal Appeal No.56/2017 is hereby set aside. The Revision stands disposed of, in view of the amicable settlement between the parties.
