By the impugned order, the learned trial Judge has rejected applications (Exh.62 and 63) filed by the present petitioner/defendant and by defendant Nos. 2 to 5 praying that Exhibit Nos. 47, 48 and 49 be de-exhibited. According to the defendants, there are no pleadings about those documents and therefore, those documents cannot be admitted in evidence.

After considering the nature of the controversy, it is clarified that giving of exhibit numbers to the documents in question will not affect the right of the defendants to point out to the trial Court at the time of hearing of the civil suit that the documents cannot be treated to be proved only because they are exhibited.

With the above observations, the petition is dismissed. No costs.
