Learned counsel for the petitioners moved civil application being Civil Application (CAW) No.1902 of 2017 for restoration of the petition which is rejected for non-service of notice on respondent No.3 and non-supply of correct address within the stipulated period. The petitioner has explained in the civil application that he came to know of the correct address after the petition was rejected. He prays for condonation of delay of 22 days in filing the civil application and permission to amend the address of respondent No.3 in the cause title and accordingly seeks to serve the petition on the respondent.

The civil application is allowed in terms of prayer clauses (a) and (b) and petition is restored to file. The amendment of the address to be carried out in the cause title of the petition within a period of two weeks from today.The petition be duly served on respondent No.3 at her correct address. The notice to be served with returnable date as 18th September, 2017.
