This is an application for permission to withdraw the amount of compensation deposited by the appellant in this Court. Since this appeal is being listed for final disposal along with connected appeal on 01.03.2018, for the present, the applicant/respondent no.3 is permitted to withdraw 50% of the amount deposited in this Court subject to filing an undertaking that in the event appeal is allowed, the respondent no.3 shall refund the said amount to the appellant. The learned counsel for the respondent no.3 submits that the said respondent is handicapped as she has suffered from Polio and it will be difficult for her to travel all the way from Akola to collect the aforesaid amount. In this backdrop, the Registry of this Court is directed to transfer 50% of the amount of the compensation deposited by the appellant to the Motor Accident Claims Tribunal, Akola, for disbursal to the said respondent.

This is an application for condonation of delay in filing the appeal. For the reasons stated in the application, the application is allowed and the delay is condoned.
