Present application is filed for modification of order dated 28/09/2022. It is submitted that the appellant does not have any family member, except the widow mother and she does not have the solvency nor have any relatives to stand as surety.

Considering the facts, the order dated 28/09/2022, is hereby modified.

The Clause -(iii) is modified as under:

"iii) The appellant - Sharukh Kha s/o Hamid Kha Pathan be released on bail on his furnishing P.R. Bond of Rs.15,000/-(Rupees Fifteen Thousand Only) with one solvent surety in the like amount to the satisfaction of the learned Additional Sessions Judge, Wardha."
