The petitioner - landlord is seeking to amend the petition in order to bring on record the conduct of the tenant of persistently defaulting in payment of rent even after the judgment of the appellate Court.

Concededly, the suit seeking eviction is not founded on the default in payment of rent and the eviction is sought on the ground that the premises are bonafide needed by the landlord.

I do not see any justification in allowing the amendment. It is always open for the petitioner - landlord to initiate appropriate proceedings seeking eviction on the ground of default. The default may not have any bearings on the issue involved in this petition.

Application is rejected.
