Heard Mr. Bhamburkar, Advocate for applicant and Mr. Chavan, Advocate for non applicant.

Learned counsel for the non applicant is taking serious objection for restoration of the second appeal. For the reasons stated in the application, the application is allowed. Second Appeal No.377/2003 is restored to file subject to payment of costs of Rs.1,000/- to the High Court Bar Association, Nagpur within a period of one week. The applicant shall produce receipt showing payment of the costs to the High Court Bar Association. The application is disposed of accordingly.
