The applicants are apprehending their arrest in connection with Crime No.95/2017, registered with Police Station, Chimur, Dist. Chandrapur for an offence punishable under Sections 420, 467 and 468 of the Indian Penal Code.

The FIR is lodged by one Hemant Charpe.

From the FIR, it is clear that the allegations are mainly against one Avinash Khade, who has sold the plots in question to various persons. It is reported that the said Avinash Khade was arrested during the course of investigation and subsequently, he is released on bail by the learned Sessions Judge.

Applicant no.1-Raju Vitthalrao Raggad is Talathi and applicant no.2-Dilip Vitthalrao Chahare is Circle Officer. According to the learned A.P.P. the offence is not registered against these two applicants however they are apprehending their arrest.

aba608.17.odt Both the applicants are working in Revenue Department of the State Government. Therefore, there is least possibility of their absconsion and they not being available to the course of justice. From the submissions made by the learned counsel for the applicants and the A.P.P. for the State, it is clear that the present applicants have acted in discharge of their duties on the basis of the registered sale deeds which were produced before them. When the matter was listed before this Court on 23.08.2017, looking to the nature of accusation made against the present applicants, this Court had granted ad interim bail to the applicants on a condition that the applicants shall join the investigating officer by attending Police Station, Chimur on 01.09.2017 and 03.09.2017 and shall be with the investigating officer between 11.00 a.m. to 5.00 p.m.

Today, when the matter was listed, learned counsel for the applicants submits that as per the directions, the applicants have attended the investigating officer on the aforesaid dates and they were interrogated by the investigating officer accordingly.

In that view of the matter, the application is allowed. Ad interim bail granted to the applicants on 23.08.2017 is confirmed.

The application stands disposed of accordingly.
