NOVEMBER 11, 2025 1) Heard learned counsel for the petitioner.

2) The present petition is directed against the order passed by the learned Labour Court, Chandrapur in Complaint (ULP) No.39/2012 dated 31/01/2015, whereby the complaint filed by the respondent came to be allowed and directed to reinstate him with continuity of service. The said order was assailed by filing Revision (ULP) No. 54/2015 before the learned Industrial Court. In Revision, learned Industrial Court had confirmed the order passed by the learned Labour Court. 3) I have gone through the orders passed by the learned Labour Court as well as learned Industrial Court. The Labour Court allowed the complaint and the same is confirmed by the Industrial Court. As far as preliminary issue about the perversity of findings is concerned, the same has attained the finality as it was not challenged.

Therefore, the Labour Court and the Industrial Court have not committed any error while passing the orders. Hence, I do not find any reason to interfere with the orders passed by the Labour Court and Industrial Court under Article 227 of the Constitution of India. Hence, the petition is dismissed. No order as to costs.
