DATE : 12-04-2023 The petition questions the order dated 25-7-18 passed by the CGIT, whereby the termination of the services of the petitioner and denying the claim of applicant for one month salary and reinstatement has been held to be just, fair and legal and what has been awarded is lump-sump compensation with 6% interest. The learned Counsel for the petitioner submits that the termination of the petitioner, was illegal, and therefore there ought to have been an order of reinstatement. She, however, does not dispute that the engagement of the petitioner was as a casual labourer and not against any sanctioned vacant post, in view of which, the termination cannot be questioned. The only question is the grant of compensation in lump-sum and considering that the petitioner had been engaged by the respondent for more than a period of 3 years, the compensation of Rs 10,000/- is clearly inadequate and needs to enhanced.

In that view of the matter, the compensation is

2/2 4 enhanced to Rs.50,000/- with interest @ 5% per annum from the amount due to the date of actual payment. The petition is partly allowed in above terms. No costs.
