Heard the learned counsel for the parties.

This is an application filed under Section 24 of the Civil Procedure Code by the applicant - wife for transfer of H.M.P. No. A-577 of 2018, which is pending on the file of Principal Judge, Family Court, Nagpur to the Principal Judge, Family Court, Pune. It is submitted that both the parties lastly resided together at Pune and at present also both the parties are residing in Pune. It would be convenient for both the parties if the proceedings which are pending before the Principal Judge, Family Court, Nagpur are transferred to the Principal Judge, Family Court, Pune.

The learned counsel for the non-applicant objected the relief in the application, however, he

2511mca985.19 could not point out any hardship which could be faced by the non-applicant if the matter is transferred to Court at Pune.

For the reasons aforestated, present Application is allowed and H.M.P. No. A-577 of 2018 pending on the file of Principal Judge, Family Court, Nagpur is directed to be transferred to the Principal Judge, Family Court, Pune.

Misc. Civil Application is disposed of accordingly. However, in the facts and circumstances of the case, there shall be no order as to costs. JUDGE *GS.
