DATE : 28/11/2019 We have heard this matter almost completely. However, before hearing could be completed, it was suggested on behalf of the respondent nos.2 and 3 that the present tender notice can be withdrawn and fresh tender notice inviting tenders for the same work could be issued. As there was no opposition to the suggestion, we granted opportunity to the respondent nos.2 and 3 to file on record a specific affidavit in that regard.

2811wp4940.18.odt Now, the affidavit has been produced before this Court and it is marked "X" for identification. The affidavit informs that the respondent nos.2 and 3 withdraw the tender notice which is the subject matter of this petition and would issue a fresh tender notice for the same work in due course of time.

In view of the statements made in the affidavit, which we accept, nothing survives in the petition and therefore, the writ petition is disposed of accordingly. No order as to costs.
