NAGPUR BENCH, NAGPUR Writ Petition No.5260 of 2014 (Sandip Ramesh Ghatol and another v. Vasant Shriram Deulkar and others) Office Notes, Memoranda of Coram, appearances, Court's orders or directions Court's or Judge's orders and Registrar's order Smt. Vaishali Khadekar, Advocate for Petitioners. Shri R.V. Shiralkar, Advocate for Respondents. Coram : R.K. Deshpande, J.
Date : 22 nd February, 2016 This petition challenges the order passed by the Trial Court dismissing the application under Order VII, Rules, 3, 6 and 11(b) of the Code of Civil Procedure. The objection was that as per Order VII, Rule 3 of the Code, the boundaries of the suit property have not been identified. There is no map and the plaintiffs are not in possession of the suit property, and therefore the plaint is required to be rejected. The plaint is also not properly valued and the court fee too is not paid. All the aforesaid questions can be gone into by the Court after framing the issues. No interference is called for. The petition is dismissed.
Judge.
