By this writ petition, the petitioner - Trust has challenged order dated 02.09.2021 passed by the Assistant Charity Commissioner, whereby direction was given for holding election in the respondent No.1 - Trust.

The principal ground raised in the present petition is that since the respondent No.1 - Trust was de-registered, such a direction could not have been granted. The material on record shows that although the respondent No.1 - Trust was deregistered, on 02.09.2021, the Assistant Charity Prity
2 / 2 918.wp147.2022 Commissioner passed an order recording that the Trust is not defunct and it is actually running. 3.
Therefore, the principal ground raised in the present writ petition is found to be without any basis.

It was then submitted that the petitioner - Trust came into existence after respondent No.1 - Trust was de-registered. Even if that be so, the two entities appear to be distinct and the direction given by the Assistant Charity Commissioner for holding elections of the respondent No.1 - Trust, cannot be interfered with in the backdrop of such admitted facts.

In view of the above, there is no merit in the present writ petition and accordingly, it is dismissed.
