Criminal Application (APPR) No.179 of 2017 This is an application moved by the non-applicants seeking directions against applicant Avinash to deposit amount of maintenance with the Family Court at Nagpur. Heard learned counsel Shri M.I. Mourya for the non-applicants, applicants in this application, and learned counsel Shri V.R. Choudhari for applicant Avinash. Avinash, submits that he has no objection for allowing the present application.
In that view of the matter, the application is allowed and disposed of.
Applicant Avinash is directed that hence forth he .....2/-
shall deposit maintenance before the Family Court. Criminal Application (APPR) No.180 of 2017 This is an application filed by the original nonapplicants for grant of permission to withdraw the amount. This Court on 25.4.2017 granted the Stay in favour of applicant Avinash on a condition that he should pay Rs.20,000/- per month. Accordingly, as per the application, applicant Avinash has deposited amount of Rs.1,60,000/- vide C.C.D.R. No.3139.
Avinash, thereafter, also deposited Rs.20,000/-. Thus, total Rs.1,80,000/- is deposited by applicant Avinash. Non-applicants Sau. Sushma Avinash Nandgave and Ku. Khushi Nandgave are seeking permission to withdraw the amount.
Avinash has no objection for withdrawal of the said amount. In that view of the matter, non-applicants Sau. Sushma Avinash Nandgave and Ku. Khushi Nandgave are permitted to withdraw amount of Rs.1,80,000/- deposited by applicant Avinash before this Court since the amount is towards maintenance.
It is made clear that the non-applicants will be .....3/-
entitled to withdraw amount deposited hence forth by applicant Avinash before learned Judge of the Family Court. The application is allowed and disposed of.
Criminal Application (APPR) No.178 of 2017 This is an application moved by the original nonapplicants for directing applicant Avinash to pay monthly maintenance of amount of Rs.30,000/-.
Avinash wants four weeks' time to file the reply. Looking to the fact that today itself this Court has passed order of withdrawal of maintenance amount and the non-applicants are entitled to withdraw amount of Rs.1,80,000/-, prayer made by learned counsel Shri V.R. Choudhari for applicant Avinash to file a reply is just.
Put up this application for further consideration on 3.10.2017.
