Shri A.M. Quazi, counsel for the R-1 & 2.
Shri A.S. Fulzele, Additional G.P. for the R-3. Shri S.S. Sanyal, counsel for the R-4.
CORAM : SMT. VASANTI A NAIK AND MRS. SWAPNA JOSHI, JJ.
DATE : DECEMBER 9 , 2016.
Shri Dharmadhikari, the learned Senior Counsel for the petitioner, states that though more than a couple of prayers are made in the writ petition, the grievance of the petitioner would stand redressed if this Court grants the alternate prayer made in Prayer Clause (a) and directs the respondents to decide the final layout plan and revised building plan submitted by the petitioner-Company within a time frame.
Since the prayer made by the petitioner-Company is innocuous, the same needs to be granted.
Shri Quazi, the learned counsel for the respondent nos.1 and 2, states that at least sixty days time would be required for a decision on the final layout plan and then the building plan would be considered.
In view of the statements made by the learned counsel for the respondent nos.1 and 2, we dispose of the writ petition with a direction to the respondent nos.1 and 2 to take a decision on the final layout plan and revised building plan submitted by the petitioner-Company within ninety days.
Order accordingly. No costs.
