Shri W.N. Nayse, Advocate states that Advocate Shri Kanungo is now looking after the matter and seeks time.

Heard Shri A.N. Ansari Advocate for original respondent No.3 and Shri R.R. Srivastava Advocate for the original appellant. Considering the nature of directions given in the judgment delivered in Appeal Against Order No.5/2018 on 4th April, 2018, in my view, the original respondent No.3 - Dharampeth Mahila Multi-State Co-operative Society can move the trial Court for redressal of it's grievance as made in this civil application. If such application is moved, the learned trial Judge shall decide the application, according to law, within one month. The civil application is disposed. In the circumstances, the parties to bear their own costs.

In view of order passed on Civil Application No.60/2018, the learned Advocate for the original appellant seeks permission to withdraw the application. The application is disposed as withdrawn. In the circumstances, the parties to bear their own costs. 4.

The original appellant will be at liberty to make the submissions as made in this application, before the trial Court. It would be open for the learned trial Judge to consider the submissions made by the parties on their own merits.
