Jaiswal, Advocate for the petitioner. Mrs. Barabde, A.G.P. for respondent no.1.
Shri V.B. Bhise, Advocate for respondent no. 2. CORAM : ROHIT B. DEO, J.
DATED :
21/03/2022.
Heard.
2.
Learned Counsel for the respondent 2 Mr. Bhise points out that the order impugned, is set aside in Appeal, which is preferred by the other original non-applicants. 3.
While this petition is rendered infructuous, I note that the petition is filed without availing the statutory remedy, which was rightly availed by the Co-applicant/nonapplicant. Indeed, there is a reason to believe, that filing of the petition was a tactical move and the non-applicants, who have a common interest, were trying their luck, both in the statutory remedy of appeal and then in petition. 4.
The petition is dismissed with costs of Rs.10,000/- (Rupees Ten Thousand only), to be deposited with the High Court Legal Services Sub-Committee, Nagpur, within the next seven days.
5.
If the costs is not deposited, the Registrar (Judicial) shall initiate appropriate action. JU DGE
