21ST NOVEMBER, 2015.
Heard.
The matter was referred to the mediator with the consent of the learned Counsel for the parties. The mediation has been successful and the report of the mediator is placed on record. The parties have arrived at an amicable agreement for the settlement of their dispute.
We have perused the agreement in respect of the settlement of the dispute. The same is signed by the parties as well as their respective counsel. The mediator has also signed the agreement. It appears that by the said agreement, the parties have agreed to dissolve the marriage by securing a decree of divorce. The wife has agreed to waive her claim for past, present and future maintenance. The parties have also agreed to withdraw all the adverse allegations made against each other and have further agreed not to interfere with the personal and domestic life of each other. We find that the terms of the settlement are just and reasonable.
Hence, the Family Court Appeal is disposed of in terms of the agreement in respect of the settlement of the dispute dated 12.10.2015. A decree of divorce is passed and the marriage solemnized between the parties is dissolved on the terms and conditions mentioned in the agreement dated 12.10.2015. A decree be drawn accordingly.
