SEPTEMBER 12, 2017 Heard Mr. S. P. Gadling, Advocate for applicant and Mr. I.Damle, A.P.P. for non applicantState. This is an application for anticipatory bail. The applicant is apprehending his arrest in connection with Crime No.162/2017, registered with Police Station, Armori, Dist.Gadchiroli for an offence punishable under Section 65 (e) of the Maharashtra Prohibition Act, 1949. Looking to the nature of accusations made, this Court had on 23.08.2017 granted ad interim protection to the applicant with a direction that the applicant shall attend Police Station on 26.08.2017, 28.08.2017, 31.08.2017 and 01.09.2017 and it was directed that he shall be with the investigating officer between 11.00 a.m. to 5.00 p.m. on the aforesaid dates. Mr. Damle, learned A.P.P. on instructions from the investigating officer states that the applicant has attended the police station on the aforesaid dates
aba613.17.odt and the investigation vis-a-vis the applicant is already over. As per the investigating officer, the custodial presence of the applicant is not necessary.
In view of the fact that the applicant has attended the investigating officer on the aforesaid dates and his interrogation is already over, custodial presence of the present applicant is not necessary.
In that view of the matter, the application is allowed. Ad interim bail granted to the applicant on 23.08.2017 is confirmed.
The application stands disposed of accordingly.
