Admittedly, the civil suit, questioning the very same relinquishment deed, is filed by the present petitioner. On the basis of the complaint lodged by him, cognizance of his grievance also appears to have been taken. Learned Judicial Magistrate Fist Class, on the application of the investigating officer, forwarded the documents to the Central Forensic Science Laboratory at Calcutta. Not satisfied with the report, the petitioner wants that documents should now be forwarded to the similar authority at Delhi. Learned counsel Shri S.V. Sirpurkar for the petitioner, upon instructions, states that the petitioner is ready and willing to bear expenditure of such examination by the Central Forensic Science Laboratory at Delhi. Learned Additional Public Prosecutor Shri N.S. .....2/-

wp769.15 Rao for the respondents is opposing the request. As the civil suit, questioning the same documents, is already pending, we are not inclined to intervene in the matter in extraordinary jurisdiction. Keeping all the contentions of the petitioner open, we dispose of the criminal writ petition. No costs. JUDGE JUDGE !! BRW !!
